Definitions
-
The Client: The person who books the service.

The Company: Karen Mackintosh trading as M.a.s.kbykaren.

The Agreement: The agreement between the Client and the Company, confirmed by email or electronic communication, for provision of the service.

The Fee: The amount payable by the Client to the Company for the service in the Agreement.

The Event: The occasion for which the service has been agreed.
-
The Party: Persons in addition to the Client requiring services at the Event, as well as those involved with the Client or the Client’s associates.

The Team: Members of the M.a.s.kbykaren styling team as and when advised.
Liability
M.a.s.kbykaren is not liable for any third-party suppliers that are recommended.
M.a.s.kbykaren is insured by Just Hair and Beauty Insurance. This is a trading style of Adler Fairways Insurance Brokers.
The Client is responsible for informing the Company of any allergies, sensitivities, or medical conditions prior to the service. Patch tests are available upon request. The Company cannot accept liability for reactions or conditions that occur due to information not disclosed by the Client or of which the Client was unaware at the time of service.
Bookings
Event bookings are secured upon confirmation by email or electronic communication from the Company. This confirms the Agreement and secures the Company’s availability for the Event on the agreed date and time for the agreed Fee.

The full cost of a booking is incurred if a cancellation is received less than 4 weeks before the Event.

Cancellations are only deemed valid if received via email or electronic communication and acknowledged by the Company.

The Fee is always agreed via email or electronic communication; verbal agreements are not considered valid.
Event bookings are secured upon receipt of a deposit, the amount of which will be agreed via email or electronic communication. Enquiries for which a deposit has not been paid are not confirmed and availability cannot be guaranteed.

The Company’s availability for the Event cannot be guaranteed if the final balance has not been received at least 1 week before the Event.

All bookings must be paid in full 1 week before the Event. Failure to pay by this date will result in forfeiture of the booking and deposit.
General Deposits and Booking Fee
A small non-refundable booking fee will be charged to secure the date in the Company’s diary. This booking fee is separate from, and in addition to, any deposit that may later be required. It is payable at the time of booking and ensures the Company’s availability for the agreed date.
A further deposit will be requested — most often after a trial has taken place. Should a trial not be applicable, this deposit will be requested following communication and agreement between both parties.
If a deposit is requested, it must be paid within the specified timescale to confirm the booking. The deposit is non-refundable if the Client fails to pay the final balance within the stated timescale or is unable to attend the appointment. No appointments will be confirmed until the deposit is received, and dates are not secured without it.
Amendments, Reductions, and Additional Services
Once a booking has been confirmed, any amendments or reductions to the agreed services must be requested in writing and approved by the Company no later than 4 weeks before the Event.
After this time, the Company is unable to accept reductions in the number or type of services booked. Should the Client or any member of the Party choose not to proceed with any part of the agreed services within 4 weeks of the Event, the full agreed Fee for those services will remain payable.
If additional services are requested on the day of the Event, these will be provided at the Company’s discretion and charged at the agreed rate. Any additional services carried out will be invoiced within 24 hours after the Event, following verbal agreement on the day. Payment for these additional services is due within 7 days of the invoice date.
Payment
All payments must be made via BACS or in cash. Cheques and PayPal are not accepted.
The price confirmed at the time of booking is final. It is the responsibility of the Client to read and accept all terms and conditions and payment requirements. By confirming a booking, the Client enters into a binding contract with M.a.s.kbykaren.
Travel Arrangements and Expenses
Travel expenses are incurred for bookings within mainland UK for every mile outside a 10-mile road distance from postcode CO16 to the venue where the service takes place, at the current government-approved rate of 45p per mile (return journey).
All parking fees, congestion charges, tolls, and any other travel-related costs incurred in attending the booking are the responsibility of the Client and will be charged in addition to mileage or other travel expenses.
Distances are calculated using an online journey planner and will be agreed with the Client as part of the Agreement. If alternative transport (such as rail or air) is required, this will be discussed and agreed during the booking process.
For travel outside mainland UK, travel expenses will include but are not limited to: travel to and from the airport, airport parking, return flights, accommodation, subsistence, travel between airport and accommodation, and any additional travel required at the destination.
Changes to travel arrangements will only be accepted via email and no later than 4 weeks before the Event.
UK Accommodation and Subsistence
If a booking requires any member of the Team to begin travelling before 6:00am and is over 50 miles from CO16, accommodation expenses will be incurred.
This will be discussed and agreed during the booking process.
A subsistence fee of £50 per Team member per 24 hours spent away from home will apply.
The Company will always endeavour to find the most cost-effective accommodation option.
Cancellation by M.a.s.kbykaren
In the unlikely event that M.a.s.kbykaren is unable to attend, an effort will be made to find another professional stylist of equal standard. If no suitable alternative is available, a full refund will be given. No further compensation will be offered.
If the booking is directly affected by circumstances beyond the Company’s control, all efforts will be made to rectify the situation, but no compensation will be offered. Clients are strongly advised to take out event insurance.
If M.a.s.kbykaren or any of her Team are made to feel uncomfortable in any way, or if the Client, any of the Party, or their associates display abusive, offensive, or inappropriate behaviour, the Company reserves the right to terminate the contract without refund.
In the event of extreme weather conditions where the Met Office issues a Red warning, the Company reserves the right to cancel without refund. Clients are strongly advised to take out insurance to cover such situations.
Time Delays
The Company will not be held responsible for delays caused by events beyond its control.
No refund or compensation will be given for delays caused by the Client, members of the Party, or their associates.
It is the Client’s responsibility to ensure all members of the Party are aware of timings and available when required.
If any member of the Party is expected to pose a challenge, a trial is strongly recommended to avoid delays on the day.
Client Responsibility
It is the Client’s responsibility to inform the Company or assigned Team member of any potential issues such as medical conditions, allergies, and/or sensitivities before the service.
Neither the Company nor its Team members can be held liable for any condition that arises or loss incurred if the Client fails to disclose relevant information.
The Company reserves the right to cancel the Agreement if the Client’s behaviour is deemed inappropriate or if a disclosed condition is considered a risk to the Client’s health and well-being. Payments already made will not be refunded in such cases.
Attendees
Please advise the Company if any attendees are makeup artists. Makeup artists who wish to receive training can be provided and quoted for this service upon request.
The Company reserves the right to cancel the Agreement if a makeup artist is present for training purposes without prior disclosure. Payments already made will not be refunded.
Team Members and Assistants
Additional members of the Team may be present if required to complete services within a specific timeframe.
All Team members and assistants are professionally trained and hold their own insurance.
If the start time of a booking is amended but the finish time remains the same, or if one artist is deemed insufficient due to time constraints, an assistant may be booked at an additional cost (confirmed via email).
Team members are not considered employees or subcontractors of M.a.s.kbykaren. Any issues, claims, or disputes regarding individual Team members must be directed through the respective insurance held by that individual.
Lash Application
Lash application is included in the makeup service price. There is no reduction in price if declined.
Partial Makeup Application
Partial makeup application is available; however, there is no reduction in price if chosen.
Photography
The Client agrees that the makeup artist may use photography for publicity purposes, including but not limited to the Company’s website and social media.
This includes photos taken by M.a.s.kbykaren (including before and after photos) and by professional photographers, the Client, members of the Party, or associates. This right cannot be rescinded retrospectively. All efforts will be made to credit those involved, but no compensation will be provided if credits are not given.
Data Protection, Privacy & Client Communication
M.a.s.kbykaren complies with all applicable data protection laws, including the UK GDPR. Any personal data provided by the Client, including contact details, medical information, and service preferences, will be used solely for the purposes of delivering the agreed services, fulfilling legal obligations, and managing the booking. Personal data will not be shared with third parties without the Client’s explicit consent, except where required by law.
All communication regarding bookings, services, or changes will only be conducted directly with the Client who made the booking. For privacy, security, and data protection reasons, service details, costs, medical information, or other booking-related matters will not be discussed with family members, friends, or associates without the Client’s written consent.
Harassment, Abuse & Discrimination
M.a.s.kbykaren and its Team are committed to providing a professional, respectful, and safe environment. Any form of harassment, discrimination, intimidation, or abusive behaviour — whether verbal, physical, or written — from the Client, members of the Party, or their associates will not be tolerated.
If such behaviour occurs at any stage, including prior to or during the booking, the Company reserves the right to immediately terminate the Agreement without refund. Where necessary, the Company may seek legal action or report incidents to the relevant authorities.
Everyday Hair and Barber Services

Further to and in addition to the terms and conditions above:
Booking and Deposits
All everyday hair, barber, and basic makeup appointments require a small non-refundable deposit or booking fee to secure the appointment. This ensures your chosen date and time is reserved.
Cancellation and No-Show Policy
Clients must provide at least 24 hours’ notice for cancellations or rescheduling. If the Client fails to attend their appointment without notice or cancels within 24 hours of the scheduled time, the full service fee or deposit will be forfeited. The Company reserves the right to refuse future bookings if a Client repeatedly fails to attend appointments without notice.
Allergies and Patch Testing
Clients are responsible for disclosing any known allergies, sensitivities, or medical conditions prior to the service. For services such as hair colouring, chemical treatments, or makeup, a patch test is strongly recommended at least 48 hours before the appointment. The Company will not be liable for any reactions or adverse effects if a patch test has not been conducted or if the Client fails to disclose relevant information.
Pricing

All published prices are starting prices and may vary depending on the specific service required. M.a.s.kbykaren reserves the right to adjust the final price based on factors such as:

The final price will always be confirmed with the Client before the service begins, ensuring transparency and agreement.

The Company reserves the right to cancel the Agreement if the Client’s behaviour is deemed inappropriate or if a disclosed condition is considered a risk to the Client’s health and well-being. Payments already made will not be refunded in such cases.
Everyday hair, barbering and beauty services are currently not offered on a drop in basis and should be pre - booked. Harassment will not be tolerated. If such behaviour occurs at any stage, including prior to or during the booking by the client or their representative, the Company reserves the right to immediately terminate the Agreement without refund. Where necessary, the Company may seek legal action or report incidents to the relevant authorities.
PLEASE NOTE: By making a booking, securing a booking, or confirming a trial, the Client accepts these Terms and Conditions fully and unconditionally.
