Definitions

The Client: The person who books the service the service.

The Company: Karen Mackintosh Trading as M.a.s.kbykaren.

The Agreement: The agreement between the Client and the Company, confirmed by e-mail, for provision of the service

The Fee: The amount payable by the Client to the Company for the service in the Agreement

The Event: The occasion for which the service has been agreed

The Party: Persons in addition to the Client requiring services at the Event as well as those involved with the Client or the Clients associates

The Team: Members of M.a.s.kbykaren styling team as and when advised.

Liability

M.a.s.kbykaren is not liable for any suppliers that are recommended.

M.a.s.kbykaren is insured by Just Hair and Beauty Insurance..

Bookings

Event bookings are secured upon e-mail or electronic communications confirmation from The Company. This confirms the Agreement and secures the Company’s availability for the Event on the agreed date and time for the agreed Fee.

The full cost of a booking is incurred if a cancellation is received less than 4 weeks before the Event.

Cancellations are only deemed valid if received via e-mail or electronic communications and acknowledged within the above time period.

The Fee is always agreed via e-mail or electronic communications, verbal agreements are not offered as they are not deemed valid by the Company.

Event bookings are secured upon receipt of a deposit, the amount of which is to be agreed via email or electronic communications, this confirms the Agreement and secures the Company’s availability for the Event on the agreed date and time for the agreed Fee. Enquiries for which a deposit has not been paid are not confirmed and therefore availability cannot be guaranteed and an Agreement is not formally in place.

Deposits are non-refundable if a cancellation is received less than 12 weeks before the Event if more than 12 weeks then the deposit is refunded in full within 7 days.

Cancellations are only deemed valid if received via e-mail or electronic communications.

The Company’s availability for the Event cannot be guaranteed for bookings where the deposit has been paid but the final balance has not been received less than 1 week before the Event.

All bookings to be paid in full 1 week before the event. Any deviation to the date in which the booking is to be fully paid by can only be agreed via email or electronic communications. Failure to pay the balance by this point will result in a forfeit of the booking security deposit.

Payment

All payment is required either by BACS or in cash. Cheque and Paypal are not accepted.

The price confirmed at the time of booking is final. It is the responsibility of The Client to read and accept responsibility for all terms and conditions, other booking conditions and payments due. By accepting and entering in to a booking you are entering in to a contract with M.a.s.kbykaren.

General Deposits

If a deposit is requested, this amount is non-refundable if the client changes their mind, does not pay the final amount within the stated timescale or is unable to attend. All deposits to be made in advance of the service. If a deposit is required, no appointments will be confirmed until received and the date discussed is not secured. 

Travel Arrangements and Expenses

Travel expenses are incurred for bookings within the mainland UK for every mile outside a 10-mile road distance from postcode CO16 to the venue where the service is to take place at the current Government approved rate of 45 pence for every mile, this is based on the return journey mileage.

Distances are calculated using an on-line journey planner and travel expenses will be agreed between the Company and Client as part of the Agreement.

If required, alternative methods of transport other than motor vehicles, such as rail or flight will be discussed and agreed with the Client during the booking process.

Changes to travel arrangements will only be accepted via email and no later than 4 weeks before the date of the event.

For travel outside of mainland UK, travel expenses will be agreed between the Company and Client as part of the Agreement. To include travel expenses to and from the airport, parking at the airport, return flights, accommodation, subsistence, travel between airport and accommodation, additional travel required at the destination, etc. This is not an exhaustive list. U.K. travel distances calculated as above.

U.K. Accommodation and Subsistence

For a booking that requires any member of the team to start travelling prior to 6.00am and is over 50 miles from CO16 accommodation expenses will be incurred.

This will be discussed and agreed with the Client during the booking process.

£50 will be charged for subsistence per Team member for every 24 hours spent away from home for a booking.

The Company will always endeavour to find the most cost-effective option for accommodation.

Cancellation of the booking byM.a.s.kbykaren

In the unlikely event that M.a.s.kbykaren is unable to attend, she will endeavour to find another professional stylist of equal standard.

Where no other suitable alternative can be offered, a full refund will be given to the client. No further compensation will be offered.

If the booking is directly affected by circumstance beyond the control of the M.a.s.kbykaren -

Where possible the stylist will endeavour to rectify such situations however no compensation will be offered on the stylists part. It is strongly advised that you take out insurance to cover you against these situations.

If M.a.s.kbykaren or any of her team are made to feel uncomfortable in any way, or if The Client, any of the Party  or associates or representatives display abusive or offensive behaviour they have the right to terminate the contract without refund.

Where there is a mismatch in style or approach, and you are not open to professional advice or guidance, M.a.skbykaren has the right to terminate the contract without refund.

In the event of extreme weather conditions, where the Met Office have issued a 'Red' warning,M.a.s.kbykaren has the right to cancel without refund. Taking out insurance is strongly advised if this is a concern.

Time Delays

M.a.skbykaren will not be held responsible for any delays caused by events beyond her control.

No refund or compensation will be given in the event of delays caused by The Client, any members of the Party or their associates. If you suspect any member of the Party may pose as a challenge in any way, they are encouraged to have a trial to avoid potential delays on the day.

Please ensure that every member of The Party is aware of timings on the day and that they stay available.

CLIENT RESPONSIBILITY

It is the Client’s responsibility to inform M.a.s.kbykaren or the Company's team member who is engaged to provide the service of any potential issues such as but not limited to medical conditions, allergies, and/or sensitivities. Neither the Company nor it's team member  can be held liable for any condition that arises or loss incurred by the Client if the Client has not informed the Company and/or Team member of any known conditions as stated above, or of any conditions unknown to the Client at the time of the service.

The Company and/or Team member reserve the right to cancel the Agreement if the behaviour of the Client is deemed inappropriate and/or if the Client reports a condition that the Company and/or Team member deem as a risk to the Client’s health and well-being. In these cases any payments that have already been made by the Client for the service are non-refundable.

Attendees 

Please advise The Company if any attendees are Makeup Artists who require training. This service is available and can be quoted for upon request.  The Company and/or Team member reserve the right to cancel the Agreement if a Makeup Artist is in attendance for the purpose of learning and this has not been disclosed prior. In this case any payments that have already been made by the Client for the service are non refundable.

Team members

Additional members of the Team will be present by  invitation from M.a.s.kbykaren if there is a time constraint and it is not possible to provide the makeup for the Party without more team members.

Assistants: If the start time for a booking is amended to be later than in the initial Agreement, however the finish time is to remain the same; or if a booking is requested for one Team member but is deemed by the Company not to be possible for one person due to time constraints , an assistant to the makeup artist can be booked per booking. Price to be confirmed electronically.

Other Matters

Lash Application

Lash application is included in the price for the makeup service, there is no reduction in price for any makeup service if they are declined.

PARTIAL MAKEUP APPLICATION

This is available, there is no reduction in price for any makeup service if this is required.

PHOTOGRAPHY

The client agrees that the makeup artist may use any photography for publicity purposes which include but are not limited to the makeup artists website and social media pages.

This includes photos taken by M.a.s.kbykaren (possibly before and after photos) and photos taken by a professional photographer, the Client, a member of The Party or associates. This right is not one that can be recinded in retrospect. All efforts shall be made to credit those involved. No reward or recompense shall be made should credits not be made.

PLEASE NOTE THAT BY MAKING A BOOKING, SECURING A BOOKING OR CONFIRMING A TRIAL THE CLIENT ACCEPTS THESE TERMS AND CONDITIONS FULLY AND UNCONDITIONALLY.
